In the fast-paced South African business landscape, the Basic Conditions of Employment Act (BCEA) isn’t just a set of rules for big corporations—it is the legal foundation for every small business. Navigating labour laws can feel like a minefield, but understanding the basics is your first line of defence against costly CCMA disputes.

The 45-Hour Rule & Overtime Pitfalls

The BCEA is very specific about working time. For most employees, the ordinary hours of work are a maximum of 45 hours per week.

  • The Break-down: If your staff work 5 days a week, that’s 9 hours a day. If they work more than 5 days, it’s 8 hours a day.
  • Overtime Reality: Overtime is voluntary and must be agreed upon. It is capped at 10 hours per week and must be paid at 1.5 times the normal wage (or 2.0 times on Sundays/Public Holidays).

Leave Entitlements: More Than Just Holidays

Disputes over leave are one of the leading causes of friction in small businesses. Ensure your records reflect these three core categories:

  1. Annual Leave: 21 consecutive days (or 1 day for every 17 days worked).
  2. Sick Leave: 30 to 36 days in a 3-year cycle. Note: A medical certificate is only required if the employee is absent for more than two consecutive days.
  3. Family Responsibility Leave: 3 days per year for full-time employees (for births, illnesses, or deaths in the immediate family).

The “Paper Trail” Protection

The Department of Employment and Labour emphasizes that “good faith” verbal agreements do not hold up in court. To protect your business, you must provide every employee with written particulars of employment (a contract) on their first day.

  • Does every employee have a signed contract?
  • Are you providing compliant payslips every month?
  • Are you keeping records for at least 3 years?
